1. Aceptación

Al descargar, instalar o usar la aplicación móvil Lap2run ("la App"), aceptas estos Términos de Servicio ("Términos") en su totalidad. Si no estás de acuerdo, no uses la App. Estos Términos constituyen un contrato vinculante entre tú ("usuario") y DBLV LLC, sociedad de responsabilidad limitada constituida en el estado de Wyoming (Estados Unidos), con domicilio en Sheridan, WY ("nosotros").

2. Qué ofrecemos

Lap2run es una aplicación social de deporte que permite registrar entrenamientos, conectar con otros deportistas de tu nivel y zona, programar sesiones conjuntas, compartir tu progreso y consumir un feed social deportivo. La App incluye integración opcional con Apple HealthKit y Google Health Connect, notificaciones push, "Live Activities", "encuentros en vivo", chats y otras funciones.

3. Edad mínima

Para usar Lap2run debes tener al menos 14 años en España o la edad mínima de consentimiento digital en tu país de residencia. Los menores entre 13 y 14 años solo pueden usar la App con consentimiento expreso de sus padres o tutores legales. Lap2run no está dirigida a menores de 13 años.

4. Tu cuenta

Eres responsable de la información que proporcionas y de mantenerla actualizada.
Eres responsable de la actividad que ocurra en tu cuenta. Mantén tus credenciales seguras.
Si detectas un uso no autorizado de tu cuenta, escríbenos a legal@lap2run.com.
Está prohibido crear cuentas en nombre de otra persona o suplantar identidad.

5. ⚠️ Disclaimer médico — IMPORTANTE

Lap2run no sustituye el consejo médico profesional. Consulta a un médico antes de comenzar un programa de entrenamiento, especialmente si tienes condiciones cardiovasculares, lesiones previas, embarazo, o cualquier circunstancia de salud que requiera supervisión.

Las métricas mostradas (frecuencia cardíaca, ritmo, calorías, distancia) son estimaciones basadas en sensores del dispositivo y modelos estadísticos. No deben usarse para diagnóstico ni tratamiento médico.

Asumes íntegramente el riesgo de cualquier lesión, accidente o problema de salud derivado del uso de la App o de las actividades deportivas que registres con ella.

6. Limitaciones de la información GPS

El seguimiento por GPS está sujeto a las limitaciones técnicas del dispositivo, la cobertura satelital y las condiciones meteorológicas. No utilices Lap2run como sistema de navegación de emergencia ni como única referencia de localización en zonas de riesgo (montaña, mar abierto, áreas remotas). Lleva siempre un sistema de orientación alternativo y avisa a alguien de tu ruta antes de salir.

7. Conducta del usuario

Al usar Lap2run te comprometes a NO:

Acosar, insultar, amenazar o discriminar a otros usuarios.
Publicar contenido ilegal, violento, sexual explícito o que infrinja derechos de terceros.
Usar la App para spam, fraude, captación comercial no autorizada o ingeniería social.
Falsear datos de actividad o manipular el sistema de matchmaking, retos o ranking.
Interferir con la infraestructura, hacer reverse-engineering, descompilar o intentar acceder a partes restringidas del servicio.
Recoger datos de otros usuarios mediante scraping o medios automatizados.
Suplantar a otra persona, marca o entidad.

Nos reservamos el derecho a suspender o terminar cuentas que infrinjan estos términos, sin previo aviso si la gravedad del caso lo exige.

8. Tu contenido

Conservas la propiedad del contenido que publicas en Lap2run (fotos, vídeos, comentarios, mensajes, actividades). Al publicarlo, nos otorgas una licencia mundial, gratuita, no exclusiva para alojarlo, mostrarlo a otros usuarios según los ajustes de privacidad que hayas elegido, y procesarlo para el funcionamiento del servicio. Esta licencia termina cuando borras el contenido o tu cuenta, salvo que ya estuviera incorporado en publicaciones de otros usuarios (e.g. menciones, capturas).

9. Compras dentro de la app

Si en el futuro Lap2run incorpora funcionalidades premium o suscripciones, las compras se procesarán a través de la App Store de Apple o Google Play, sujetas a sus condiciones. Consultaremos contigo y publicaremos términos específicos antes de activarlas.

10. Servicios de terceros

Lap2run integra servicios de terceros (Apple HealthKit, Google Health Connect, Apple Sign In, Google Sign In, mapas, push notifications). Cada uno tiene sus propios términos y políticas, que prevalecen sobre estos para lo que afecta a su servicio. No somos responsables del contenido o las prácticas de esos terceros.

11. Disponibilidad y modificaciones del servicio

Hacemos esfuerzos razonables para mantener la App disponible, pero no garantizamos disponibilidad continua. Podemos actualizar, modificar, suspender o discontinuar funciones sin previo aviso. Si discontinuamos la App entera, te lo avisaremos con al menos 30 días de antelación y te facilitaremos exportar tus datos.

12. Limitación de responsabilidad

En la máxima medida permitida por la ley aplicable:

La App se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo.
No seremos responsables de daños indirectos, incidentales, especiales o consecuentes derivados del uso o la imposibilidad de uso de la App.
Nuestra responsabilidad total acumulada hacia ti no excederá la cantidad que nos hayas pagado en los 12 meses anteriores al hecho que da lugar a la reclamación, o 50 € si no nos has pagado nada (caso del servicio gratuito).

Nada en estos Términos limita tus derechos imperativos como consumidor bajo la legislación aplicable.

13. Indemnización

Aceptas indemnizarnos y mantenernos indemnes frente a reclamaciones de terceros derivadas de tu uso indebido de la App, de tu contenido publicado o de tus infracciones de estos Términos.

14. Suspensión y terminación

Puedes terminar tu cuenta en cualquier momento desde Más → Eliminar cuenta o escribiéndonos a legal@lap2run.com.

Podemos suspender o terminar tu cuenta si infringes estos Términos. En ese caso, te notificaremos por correo electrónico siempre que sea posible, salvo que la suspensión sea inmediata por motivos de seguridad o legalidad.

15. Modificaciones de los Términos

Podemos actualizar estos Términos para reflejar cambios en la App o en la legislación. Los cambios significativos te los notificaremos por correo o en la App con al menos 15 días de antelación. El uso continuado tras la entrada en vigor implica aceptación. Si no estás de acuerdo, puedes cerrar tu cuenta.

16. Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes del estado de Wyoming, Estados Unidos, sin tener en cuenta sus normas de conflicto de leyes. Para cualquier controversia que no pueda resolverse amistosamente, las partes se someten con carácter exclusivo a los tribunales estatales o federales con competencia en el condado de Sheridan, Wyoming.

Lo anterior se aplica sin perjuicio de los derechos imperativos del consumidor reconocidos por la legislación de su país de residencia. Si eres consumidor residente en la Unión Europea, el Espacio Económico Europeo, el Reino Unido u otro territorio cuyas leyes te otorguen protecciones de orden público no renunciables (incluido el derecho a litigar ante los tribunales de tu domicilio), conservas íntegramente esas protecciones y este apartado se interpretará de forma compatible con ellas.

Terms of Service

1. Acceptance

By downloading, installing, or using the Lap2run mobile app ("the App"), you accept these Terms of Service ("Terms") in full. If you don't agree, don't use the App. These Terms constitute a binding contract between you ("user") and DBLV LLC, a limited liability company organized under the laws of the State of Wyoming (USA), with registered address in Sheridan, WY ("we", "us").

2. What we offer

Lap2run is a social fitness app that lets you record workouts, connect with athletes of your level and area, schedule joint sessions, share your progress, and consume a sports-oriented social feed. The App includes optional integration with Apple HealthKit and Google Health Connect, push notifications, Live Activities, "live encounters", chats, and other features.

3. Minimum age

To use Lap2run you must be at least 14 years old in Spain or the digital consent age in your country of residence. Minors between 13 and 14 may only use the App with explicit parental or guardian consent. Lap2run is not directed to children under 13.

4. Your account

You are responsible for the accuracy of the information you provide and for keeping it up to date.
You are responsible for activity that occurs under your account. Keep your credentials safe.
If you detect unauthorized use of your account, write to legal@lap2run.com.
Creating accounts in someone else's name or impersonating others is prohibited.

5. ⚠️ Medical disclaimer — IMPORTANT

Lap2run does not replace professional medical advice. Consult a doctor before starting a training program, especially if you have cardiovascular conditions, prior injuries, are pregnant, or any health circumstance that requires supervision.

Metrics displayed (heart rate, pace, calories, distance) are estimates based on device sensors and statistical models. They must not be used for medical diagnosis or treatment.

You assume the entire risk of any injury, accident, or health issue resulting from the use of the App or the activities you record with it.

6. GPS information limitations

GPS tracking is subject to device technical limitations, satellite coverage, and weather conditions. Do not use Lap2run as an emergency navigation system or as your sole location reference in risk areas (mountains, open sea, remote areas). Always carry an alternative navigation system and inform someone of your route before heading out.

7. User conduct

By using Lap2run you agree NOT to:

Harass, insult, threaten, or discriminate against other users.
Post illegal content, violent material, explicit sexual content, or content infringing third-party rights.
Use the App for spam, fraud, unauthorized commercial solicitation, or social engineering.
Fake activity data or manipulate the matchmaking, challenges, or ranking system.
Interfere with the infrastructure, reverse-engineer, decompile, or attempt to access restricted parts of the service.
Collect data from other users via scraping or automated means.
Impersonate another person, brand, or entity.

We reserve the right to suspend or terminate accounts that breach these Terms, without prior notice if severity warrants.

8. Your content

You retain ownership of content you post on Lap2run (photos, videos, comments, messages, activities). By posting, you grant us a worldwide, royalty-free, non-exclusive license to host, display to other users according to your privacy settings, and process it for the operation of the service. This license ends when you delete the content or your account, except where it has already been incorporated into other users' posts (e.g. mentions, screenshots).

9. In-app purchases

If Lap2run later introduces premium features or subscriptions, purchases will be processed through Apple's App Store or Google Play, subject to their conditions. We will notify you and publish specific terms before activating them.

10. Third-party services

Lap2run integrates third-party services (Apple HealthKit, Google Health Connect, Apple Sign In, Google Sign In, maps, push notifications). Each has its own terms and policies, which prevail over these for matters affecting their service. We are not responsible for the content or practices of these third parties.

11. Service availability and modifications

We make reasonable efforts to keep the App available but do not guarantee continuous availability. We may update, modify, suspend, or discontinue features without prior notice. If we discontinue the App entirely, we'll notify you at least 30 days in advance and provide a way to export your data.

12. Limitation of liability

To the maximum extent permitted by applicable law:

The App is provided "as is" and "as available", without warranties of any kind.
We will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the App.
Our total cumulative liability towards you will not exceed the amount you have paid us in the 12 months preceding the event giving rise to the claim, or €50 if you haven't paid anything (free tier case).

Nothing in these Terms limits your mandatory consumer rights under applicable law.

13. Indemnification

You agree to indemnify and hold us harmless against third-party claims arising from your improper use of the App, your posted content, or your breaches of these Terms.

14. Suspension and termination

You may terminate your account at any time from More → Delete account or by writing to legal@lap2run.com.

We may suspend or terminate your account if you breach these Terms. We will notify you by email when possible, except where suspension is immediate for security or legal reasons.

15. Modifications of the Terms

We may update these Terms to reflect changes to the App or applicable law. Significant changes will be notified by email or in-app at least 15 days in advance. Continued use after the effective date implies acceptance. If you don't agree, you can close your account.

16. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. For any dispute that cannot be resolved amicably, the parties submit exclusively to the state or federal courts with jurisdiction over Sheridan County, Wyoming.

The above is without prejudice to mandatory consumer rights under the laws of your country of residence. If you are a consumer residing in the European Union, the European Economic Area, the United Kingdom, or any other territory whose laws grant you non-waivable public-order protections (including the right to litigate before the courts of your domicile), those protections remain fully in force and this section shall be interpreted in a way compatible with them.
